广州:楼盘广告乱用地名最高罚10万元

昨日,广(guang)州市第十五届人(ren)大常委会第四十八次会议表决通(tong)过(guo)《广(guang)州市地名(ming)管理规(gui)定(ding)(ding)》(以(yi)(yi)下(xia)(xia)简称(cheng)《规(gui)定(ding)(ding)》)。《规(gui)定(ding)(ding)》明确,房地产建设、销售单位发布的(de)房地产广(guang)告中乱(luan)用地名(ming),逾期不改正(zheng)的(de),处以(yi)(yi)一万元(yuan)以(yi)(yi)上十万元(yuan)以(yi)(yi)下(xia)(xia)罚款。

  《规定》明确,地(di)(di)(di)(di)名(ming)(ming)(ming)(ming)命名(ming)(ming)(ming)(ming)应当遵守下(xia)列规定:明确易(yi)懂、含义健康,不(bu)得使用(yong)违背公序良俗(su)、内容含义庸俗(su)或者带(dai)有封建迷信色彩(cai)的(de)词(ci)语;尊重当地(di)(di)(di)(di)群众意愿,方(fang)便群众生(sheng)产生(sheng)活,反映(ying)当地(di)(di)(di)(di)历(li)史、地(di)(di)(di)(di)理(li)、文(wen)化和地(di)(di)(di)(di)方(fang)特(te)色;地(di)(di)(di)(di)名(ming)(ming)(ming)(ming)由专名(ming)(ming)(ming)(ming)和通(tong)(tong)名(ming)(ming)(ming)(ming)两部分组成,通(tong)(tong)名(ming)(ming)(ming)(ming)用(yong)字应当能真实地(di)(di)(di)(di)反映(ying)其实体的(de)属(shu)性、类别,建筑(zhu)物(wu)、住宅区地(di)(di)(di)(di)名(ming)(ming)(ming)(ming)通(tong)(tong)名(ming)(ming)(ming)(ming)的(de)使用(yong)应当具备与(yu)通(tong)(tong)名(ming)(ming)(ming)(ming)相适(shi)应的(de)占地(di)(di)(di)(di)面积(ji)、总建筑(zhu)面积(ji)、高(gao)度、绿地(di)(di)(di)(di)率等;同类地(di)(di)(di)(di)名(ming)(ming)(ming)(ming)的(de)专名(ming)(ming)(ming)(ming)不(bu)得重名(ming)(ming)(ming)(ming);派(pai)生(sheng)地(di)(di)(di)(di)名(ming)(ming)(ming)(ming)与(yu)主地(di)(di)(di)(di)名(ming)(ming)(ming)(ming)统一(yi),以地(di)(di)(di)(di)名(ming)(ming)(ming)(ming)命名(ming)(ming)(ming)(ming)的(de)车站、港口(kou)、码(ma)头、机场、水(shui)库(ku)等名(ming)(ming)(ming)(ming)称与(yu)所在地(di)(di)(di)(di)的(de)名(ming)(ming)(ming)(ming)称一(yi)致。

  针对(dui)近年来建(jian)筑(zhu)物、住(zhu)宅(zhai)区建(jian)设、销(xiao)售过程中公开(kai)使(shi)用未(wei)经批(pi)准(zhun)(zhun)的(de)(de)地(di)(di)名(ming)(ming)现象,《规(gui)定(ding)》明确(que),房(fang)地(di)(di)产建(jian)设、销(xiao)售单(dan)位发布的(de)(de)房(fang)地(di)(di)产广(guang)告(gao)中的(de)(de)地(di)(di)名(ming)(ming)应(ying)当(dang)与标准(zhun)(zhun)地(di)(di)名(ming)(ming)批(pi)准(zhun)(zhun)文(wen)件上的(de)(de)地(di)(di)名(ming)(ming)保持一致,并在广(guang)告(gao)版面显著位置标明有关建(jian)筑(zhu)物、住(zhu)宅(zhai)区的(de)(de)标准(zhun)(zhun)地(di)(di)名(ming)(ming)及(ji)其(qi)地(di)(di)名(ming)(ming)批(pi)准(zhun)(zhun)文(wen)号(hao)。

  若违反(fan)上述规定,房地产建设(she)、销售单位(wei)发布的房地产广告(gao)中的地名(ming)与(yu)标(biao)准地名(ming)批(pi)准文件(jian)上的地名(ming)不(bu)一(yi)致的,由民政部门责令限(xian)期(qi)改正(zheng);逾期(qi)不(bu)改正(zheng)的,处以(yi)一(yi)万元(yuan)以(yi)上十万元(yuan)以(yi)下罚款。
